Welcome to UKIYO. These Terms of Service (“Terms”) govern your access to and use of the UKIYO web application, including all features, content, and functionality made available through the Service. Please read these Terms carefully before using the Service.
By accessing or using UKIYO in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.
1. About the Service
UKIYO is a free web application designed for the enjoyment of DJ mix music. The Service provides an immersive listening environment that includes a DJ-deck-styled music player, streaming of DJ mixes published on Mixcloud via an embedded player, playlist management using browser local storage, and a dynamic music visualizer. UKIYO is operated as an independent project, and all content streamed through the Service is hosted on and delivered via Mixcloud.
The Service is provided free of charge and without any subscription or registration requirement. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
2. Eligibility and Acceptable Use
The Service is available to anyone with access to a compatible web browser. There is no age restriction beyond what may be imposed by the laws of your country of residence. By using the Service, you represent and warrant that your use will be in full compliance with these Terms and with all applicable local, national, and international laws and regulations.
In particular, you agree to:
- Use the Service solely for its intended purpose — the personal enjoyment of DJ mix music;
- Respect the intellectual property rights of the artists, rights holders, and third-party services associated with the content available through the Service;
- Refrain from taking any action that may interfere with, degrade, or disrupt the normal operation of the Service or the underlying infrastructure;
- Not attempt to access, probe, or test the security of the Service or any associated systems beyond what is explicitly authorized.
3. Prohibited Conduct
The following activities are strictly prohibited when using the Service. Violation of these prohibitions may result in suspension of your access and, where applicable, legal action. You may not:
- Gain or attempt to gain unauthorized access to any part of the Service, its backend systems, databases, or administrative interfaces;
- Conduct, initiate, or participate in any denial-of-service attack, distributed denial-of-service (DDoS) attack, or any other form of deliberate disruption;
- Scrape, crawl, index, or otherwise extract content from the Service using automated means without our express written permission;
- Reproduce, redistribute, sublicense, sell, or commercially exploit any content, trademarks, code, or materials belonging to UKIYO or its content partners without prior written authorization;
- Infringe or circumvent any copyright, trademark, patent, or other intellectual property rights held by UKIYO, Mixcloud, or any artist or rights holder;
- Upload, transmit, or otherwise introduce any malware, viruses, or malicious code into the Service or any connected systems;
- Engage in any conduct that is harassing, defamatory, fraudulent, or otherwise unlawful under applicable law.
4. Intellectual Property
All music, audio recordings, and related content accessible through the Service are the exclusive property of the respective artists, record labels, and rights holders. UKIYO does not host, store, reproduce, or redistribute any audio files. Music is delivered solely through Mixcloud's official embed API, which operates in accordance with the licensing agreements Mixcloud has established with rights holders. Your use of the Service does not grant you any rights to download, record, or redistribute the music accessed through it.
The UKIYO name, logo, visual design, and original source code are the intellectual property of the Service operator. All rights not expressly granted are reserved.
5. Third-Party Services
The Service integrates with and relies upon several third-party services, most notably Mixcloud (for music streaming) and Google Analytics (for anonymous usage measurement, where consented). Your use of those services through UKIYO is subject to the respective terms of service and privacy policies of those providers:
We are not responsible for the content, availability, accuracy, or practices of any third-party service. Links to or integrations with third-party services do not constitute an endorsement by UKIYO.
6. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
In particular, and without limitation, we are not responsible for:
- Any interruption, suspension, or permanent discontinuation of the Service, whether planned or unplanned;
- Any loss of data, including playlist data stored in browser local storage, resulting from browser updates, device changes, or cache clearing;
- Any degradation or failure of the music streaming experience caused by changes to Mixcloud's platform, API, or policies, including changes to content availability or embed functionality;
- Any inaccuracy in track metadata, artist information, or other content displayed by the Service.
7. Limitation of Liability
To the fullest extent permitted by applicable law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to use the Service in the 12 months preceding the claim, which in the case of a free service is zero.
Nothing in these Terms shall limit or exclude liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Japan, unless otherwise required by applicable mandatory law.
Note for EEA and UK residents: If you are a consumer residing in the European Economic Area or the United Kingdom, mandatory consumer protection laws of your country of residence may apply in addition to or instead of the governing law stated above. Such laws may provide you with rights that cannot be waived by contract. Nothing in these Terms is intended to limit any rights you have under applicable mandatory consumer protection legislation.
9. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. We encourage you to review these Terms periodically to stay informed of any updates. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, please discontinue use of the Service.
